Christensen Found Not Guilt of Sexual Assult - Does He Come Back?
I'm no lawyer, but I think that this type of case is very difficult to prove because it basically comes down to a 'he said, she said' situation. Christensen previously plead guilty to resisting arrest and criminal mischief. I have my opinions about this, but I'd like to hear what you guys have to say about it. Does Pelini suspend him for a few games but let him return to the team? Or should his playing days at Nebraska be over and done?Nebraska football player Andy Christensen has been found not guilty of first degree sexual assault. A Lancaster County District Court jury reached the decision on Tuesday.

I'm torn here...
…as I think he did something that night. The proof didn’t reach the standard to send him to jail, however. If he does come back to the team, he’s got a lot of time to make up since he missed spring and pre-season practice, so a reinstatement doesn’t mean he got off completely.

I kind of like Pelinis approach by getting all the facts. I dont have them either so I guess I would have to get them to make an educated decision on the matter. Other things would play into it as well, such as if he had ever been in trouble with the law before, what is his record as far as breaking team rules, has he been warned about staying out of trouble or being off the team ( must not have been or he would have been kicked off instead of suspended) etc. This is a tough decision not matter how he decides and I am glad I do not have to make it. But just knowing what I know now I probably let him back on.

Has he been in class up to this point?
Note: nothing in this comment should be construed to constitute legal advice, but merely observation.
One sticky issue with his coming back will be whether he was enrolled/got himself enrolled in order to be eligible for this semester.
The proof here was a problem, especially considering that the Lancaster County Attorney charged him (questionably) with First Degree Sexual Assault, which requires proving penetration, instead of Third Degree Sexual Assault, which would fit the alleged facts here but not require the penetration element (but is only a misdemeanor).

I am guessing....
that he had been enrolled/was getting enrolled or there wouldn’t be a question of his return. Unless they are talking next season.

Andy Christensen
My guess is that he will re-enroll as a student, if he keeps his nose clean this year, no problems with alcohol, drugs, fighting, etc. that he would be invited to join the team next year, as maybe a walk-on.
That is assuming he has the course work to finish and is willing and able to sit out a year.
